Prospectacy Ltd. is a Cyprus-based corporate entity that renders services related to the incorporation of company vehicles, the assistance in the opening of bank accounts, trust services, and accounting services as well as legal advisory to international clients.

Prospectacy Ltd. is committed to safeguard the security and integrity of personal data, which is related to the individual visitors of our corporate website as well as to our prospective and / or existing clients.

We fulfil the role of the Data Controler for all information that is collected during the course of a visit to our company’s website as well as during the course of doing business with Prospectacy Ltd.

All prospective and /or existing private clients of Prospectacy Ltd. are treated as Data subjects in the sense of the Data Protection regulation 679/2016/EU. With regards to the provisions of the aforemenioned regulation, the local management and / or the Universal Beneficial Owner(s) of all prospective and /or existing corporate clients of Prospectacy Ltd., which are physical persons that represent a legal person, are treated as Data subjects in the sense of the aforemenioned regulation.

For all enquiries related to personal data collected, which relates to an individual visitor of our corporate website as well as to our prospective and / or existing clients, Prospectacy Ltd. has appointed a Data Protection Officr (DPO). The DPO remains in an independent and protected position within our corproate structure and has an immediate and direct connection to our top level management. What Data is collected?
During the course of your visit to our corporate website, the IT infrastructure of Prospectacy Ltd. can collect information on your IP address (Internet Protocol), your geographical location, your internet access service provider, the computer or telecommunication device used and / or the length and frequency of your page visits on our corporate website.

By the use of the contact form in the ‘contact us’ section, we collect informtion on the name, surname, telephone number and email address of our prospective and / or existing clients. At Prospectacy Ltd., incoming and outgoing phone calls may be recorded for the purpose of training and improvement made to our services offered.

Doing business with Prospectacy Ltd., we collect personal data of prospective and / or existing customers by physical or electronic correspondence. This data relates to information, which we at Prospectacy Ltd. have to collect and assess in line with the legal requirements of the Republic of Cyprus on customer Due Diligence within the framework regarding KYC (Know-Your-Customer) requirements.

How do we at Prospectacy Ltd. collect that data?
The data regarding the IP address, the type of computer or telecommuniation device used, the geographical location and the internet access service providers of individual visitors of our corporate website is collected by our IT infrastructure (i.e. the server for our corporate website) as an individual visitor enters our corporate website.

Personal data related to the name and surname, telephone contact number and email address as well as other details submitted to Prospectacy Ltd. is collected by the use of the contact form in the ‘contact us’ section of our corporate website.

By using the services that Prospectacy Ltd. offes to international clients, it will be required to have prospective and / or existing clients of Prospectacy Ltd. to submit their personal data and / or data related to a corporate identity to us via physical or electronic correspondence.

How is personal data treated and stored?
Prospectacy Ltd. takes responsible for confidential treatment of your personal data. All data, which is collected by the visit of our corporate website and by doing business with Prospectacy Ltd., is stored in protected physial archives and in protected electronic databases, free from unauthorized access.

Purpose and use of personal data collected
Data that was collected by our IT infrastructure from an individual visitor of our corporate website during the entry into our corporate website is used for internal statistical and analytical purpose only.

Personal data collected or disclosed via the use of the contact form in our ‘contact us’ section on our corporate website by an individual visitor or prospective and / or existing client is used for the identification of that person as to enable communication with that person. By use of the contact form and by submission of personal data, the sender gives his consent to to give out the relevant personal data to us.

All data that relates to individual prospective and / or existing clients (physical and / or legal persons) and which Prospectacy Ltd. collects, collected and will collect in the course of rendering our corporate services to our international prospective and / or existing customers by physical or electronic correspondence, is used for the purpose of fulfilling our obligations as a service provider to the person the data is related to.

Prospectacy Ltd. may use personal data related to an individual visitor, or respectively to a prospective and / or existing client for the purpose of sending out commercial and non-commercial notifications, newsletters or announcements.

Also, internal stress testing of the security systems we apply within the frameset of our corporate risk management may be a purpose for the use of personal data related to an individual visitor of our corporate website or to prospective and / or existing clients.

Prospectacy Ltd. will notify the person, to which specific personal data relates, about the use or processing of that personal data prior to its use or processing for the purpose described in this privacy policy.

Your rights to your personal data
In line with the provisions and requirements of the Data Protection Regulation 679/2016/EU on the protection of personal data, you remain the following rights to your personal data:

– You remain the right to review all personal information, which is related to you and which was / is collected during your visit of our corporate website and during the use and processing as described in this privacy policy at any time and to check the accuracy of personal data, which is related to you individually.

– You remain the right to have done corrections, rectifications and refreshments to your personal data.

– You remain the right to have your personal data deleted partly or completely.

– You remain the right to obtain information on the use and purpose to process your personal data.

– You remain the right to limit the purpose for processing and use of your personal data.

– You remain the right to opt-out from commercial and non-commercial newsletters and notifications from Prospectacy Ltd. by notification to our DPO accordingly.

– You remain the right to have all personal data, which is related to you and which is or had been collected during your visit and use of our corporate website and during your correspondence with Prospectacy Ltd. being transferred to another Data Controler nominated by you.

Disclosures
We at Prospectacy Ltd. do not disclose any personal data to third parties without the explicit consent of the physical or legal person, to which the personal data is related.

Notwithstanding the above, rendering our corporate and financial as well as legal services to international clients will require the disclosure of personal data related to our prospective and / or existing customers on a confidiential base to public bodies, financial institutions and external auditors as well as external legal advisors. Your rights to your personal data as described above are not diminished by this.

We may also disclose personal information related to an individual client or to representant(s) of clients (when in the form of a legal person) to third parties if we are under a duty to disclose or share the relevant personal data in order to comply with any legal obligation, or in order to enforce or apply our Site Terms and Conditions. Furthermore, that personal data is permitted to be disclosed to public bodies only in cases where the disclosure concerns matters of national and/or international security, the prevention or investigation of criminal activities, law enforcements, where a public interest is given, a juridical proceeding against the person, to which the personal data is related is pending or had been initiated or completed before and/or the personal security of the individual to which the personal data is related.
